Article 1 – Scope of Application

  1. 1. Accommodation contracts and related agreements entered into between the Hotel and its guests shall be governed by these Terms and Conditions. Any matters not stipulated herein shall be governed by applicable laws and regulations, or by generally accepted customs and practices.
  2. 2. In cases where the Hotel agrees to special arrangements that do not conflict with applicable laws, regulations, or established customs, such special arrangements shall take precedence over these Terms and Conditions.

Article 2 – Application for an Accommodation Contract

  1. 1. Any person wishing to apply for an accommodation contract with the Hotel shall provide the following information:
  1. 2. If a guest requests to extend their stay beyond the originally reserved accommodation period during their stay, the Hotel shall treat such request as a new application for an accommodation contract at the time the request is made.

Article 3 – Formation of the Accommodation Contract

  1. 1. An accommodation contract shall be deemed concluded when the Hotel accepts the application described in the preceding Article. However, this shall not apply if the Hotel can prove that it did not accept the application.
  2. 2. Once the accommodation contract has been concluded in accordance with the preceding paragraph, the guest shall pay a deposit specified by the Hotel by the date designated by the Hotel. The amount of the deposit shall not exceed the basic accommodation charge for the entire stay (or for three days if the stay exceeds three days).
  3. 3. The deposit shall first be applied to the accommodation charges ultimately payable by the guest. If circumstances arise requiring the application of Articles 8 or 20, the deposit shall be applied first to cancellation charges and then to compensation for damages. Any remaining balance shall be refunded at the time payment is made in accordance with Article 14.
  4. 4. If the guest fails to pay the deposit by the date specified by the Hotel pursuant to Paragraph 2, the accommodation contract shall become void. However, this shall apply only if the Hotel has informed the guest of the payment deadline when specifying the due date for the deposit.

Article 4 – Special Provisions Exempting the Deposit Requirement

  1. 1. Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may agree to a special arrangement under which the guest is not required to pay the deposit after the accommodation contract has been concluded.
  2. 2. If a guest's baggage arrives at the Hotel prior to their arrival, the Hotel does not request payment of the deposit referred to in Paragraph 2 of the preceding Article or does not specify a due date for such payment, the Hotel shall be deemed to have agreed to the special arrangement described in the preceding paragraph.

Article 5 – Cooperation with Infection Prevention Measures

  1. 1. The Hotel may request the cooperation of any person seeking accommodation in accordance with Article 4-2, Paragraph 1 of the Japanese Hotel Business Act (Act No. 138 of 1948) regarding infection prevention and control measures.

Article 6 – Prohibited Conduct by Guests

  1. 1. Guests shall not permit any person other than the registered guest(s) to stay at the Hotel, transfer or resell their rights under the accommodation contract, or allow non-guests to use facilities designated exclusively for guests without the Hotel's prior consent.
  2. 2. The Hotel may contact the guest, using the contact information provided pursuant to Article 2, Paragraph 1, on any date prior to the scheduled arrival date for the purpose of reservation confirmation or other necessary communications. In such cases, the guest shall respond to the Hotel's communications unless prevented by unavoidable circumstances.

Article 7 – Refusal of Accommodation Contracts

  1. 1. The Hotel may refuse to enter into an accommodation contract in any of the following circumstances. However, this provision does not mean that the Hotel may refuse accommodation in circumstances other than those permitted under Article 5 of the Japanese Hotel Business Act.
  1. 2. The person seeking accommodation may request an explanation of the reasons for such refusal.

Article 8 – Guest's Right to Cancel the Accommodation Contract

  1. 1. A guest may cancel the accommodation contract by notifying the Hotel.
  2. 2. If the guest cancels all or part of the accommodation contract for reasons attributable to the guest (except where the Hotel has requested payment of a deposit pursuant to Article 3, Paragraph 2 and the guest cancels the contract before such payment is made), the Hotel shall charge a cancellation fee in accordance with Schedule 2. However, where the Hotel has agreed to the special arrangement described in Article 4, Paragraph 1, such cancellation fee shall apply only if the Hotel has informed the guest, at the time of agreeing to the arrangement, of the guest's obligation to pay a cancellation fee upon cancellation.
  3. 3. If a guest fails to arrive by 8:00 p.m. on the scheduled arrival date without contacting the Hotel (or, where an estimated arrival time has been provided in advance, within two hours after that time), the Hotel may deem the accommodation contract to have been cancelled by the guest and may process it accordingly.

Article 9 – Hotel's Right to Cancel the Accommodation Contract

  1. 1. The Hotel may cancel the accommodation contract in any of the following circumstances. However, this provision does not mean that the Hotel may refuse accommodation in circumstances other than those permitted under Article 5 of the Japanese Hotel Business Act.
  1. 2. If the Hotel cancels the accommodation contract pursuant to the preceding paragraph, the Hotel shall not charge the guest for any accommodation services or other services that have not yet been provided.
  2. 3. If the Hotel cancels the accommodation contract pursuant to Paragraph 1, the guest may request an explanation of the reasons for such cancellation.

Article 10 – Guest Registration

  1. 1. Guests shall register the following information at the Hotel upon check-in on the day of arrival:

If a guest intends to pay the charges prescribed in Article 14 by means other than cash, such as accommodation vouchers, credit cards, or other accepted methods of payment, the guest shall present such vouchers, cards, or payment instruments at the time of registration under the preceding paragraph.

Article 11 – Use of Guest Rooms

  1. 1. Unless otherwise specified in a particular accommodation plan, guests may use their guest room until the check-out time designated by the Hotel. In the case of consecutive stays, guests may use the room throughout the day, except on the day of arrival and the day of departure.
  2. 2. Notwithstanding the preceding paragraph, the Hotel may permit the use of a guest room beyond the designated hours. In such cases, an additional charge determined by the Hotel shall apply.

Article 12 – Compliance with Hotel Rules

  1. Guests shall comply with the rules and regulations established by the Hotel while on the Hotel premises, including any house rules, usage guidelines, notices, instructions, or other information posted or provided by the Hotel.

Article 13 – Operating Hours

  1. The operating hours of the Hotel's principal facilities and services are as follows. Detailed operating hours for other facilities and services are provided in the Hotel brochure, posted notices, and the in-room information guide.
  1. The operating hours stated above may be changed temporarily when necessary due to unavoidable circumstances. In such cases, guests will be notified by an appropriate method.

Article 14 – Payment of Charges

  1. 1. The breakdown and calculation of accommodation charges and other fees payable by the guest shall be as set forth in Schedule 1.
  2. 2. Payment of the accommodation charges and other fees referred to in the preceding paragraph shall be made at the front desk upon the guest's departure or whenever requested by the Hotel. Payment may be made in cash or by accommodation vouchers, credit cards, or any other method approved by the Hotel.
  3. 3. Once the Hotel has made a guest room available to the guest and the room is ready for use, the accommodation charge shall be payable in full even if the guest chooses not to stay in the room or otherwise does not make use of the accommodation.

Article 15 – Liability of the Hotel

  1. 1. The Hotel shall compensate the guest for any damage or loss suffered by the guest as a result of the Hotel's performance or non-performance of the accommodation contract or any related agreement. However, the Hotel shall not be liable where such damage or loss is not attributable to reasons for which the Hotel is responsible.

Article 16 – When the Hotel Is Unable to Provide the Contracted Guest Room

  1. 1. If the Hotel is unable to provide the guest room contracted with the guest, the Hotel shall, with the guest's consent, make every reasonable effort to arrange alternative accommodation under conditions as similar as possible to those originally agreed upon.
  2. 2. If the Hotel is unable to arrange alternative accommodation as described in the preceding paragraph, the Hotel shall pay the guest compensation equivalent to the applicable cancellation charge. Such compensation shall be applied toward any damages payable by the Hotel. However, if the inability to provide the guest room is due to reasons not attributable to the Hotel, no compensation shall be paid.

Article 17 – Handling of Deposited Property and Valuables

  1. 1. If any loss, damage, or other harm occurs to items, cash, or valuables deposited by a guest with the Hotel's front desk, the Hotel shall compensate the guest for such damage, except where the loss or damage is caused by force majeure. However, with respect to cash and valuables, if the Hotel has requested that the guest declare the nature and value of such items and the guest fails to do so, the Hotel's liability shall be limited to JPY 150,000, unless the damage was caused intentionally or through gross negligence on the part of the Hotel.
  2. 2. If any loss, damage, or other harm occurs to items, cash, or valuables brought into the Hotel by a guest but not deposited with the front desk, and such loss or damage is caused by the Hotel's intentional act or negligence, the Hotel shall compensate the guest for the resulting damage. However, with respect to items whose nature and value were not declared in advance by the guest, the Hotel's liability shall be limited to JPY 150,000, unless the damage was caused intentionally or through gross negligence on the part of the Hotel.

Article 18 – Custody of Baggage and Personal Belongings

  1. 1. If a guest's baggage arrives at the Hotel prior to the guest's arrival, the Hotel will accept and store such baggage only when prior consent has been given by the Hotel. The baggage will then be returned to the guest upon check-in.
  2. 2. If a guest's baggage or personal belongings are left behind at the Hotel after check-out, the Hotel will, in principle, retain such items while awaiting contact from the owner and will seek instructions regarding their disposition. If no instructions are received from the owner, the Hotel will handle the items in accordance with the Japanese Lost Property Act, directions from the relevant police authorities, and the Hotel's internal procedures. Cash and valuables will be delivered to the nearest police station within seven (7) days, including the date of discovery. Food, beverages, and items that may adversely affect hygiene or sanitation will be disposed of promptly in accordance with the Hotel's internal procedures.
  3. 3. The Hotel's liability for the custody of a guest's baggage or personal belongings in the cases described in the preceding two paragraphs shall be governed by Article 17, Paragraph 1 in the case of Paragraph 1 above, and by Article 17, Paragraph 2 in the case of Paragraph 2 above.

Article 19 – Parking Liability

  1. 1. When a guest uses the Hotel's parking facilities, the Hotel merely provides a parking space, regardless of whether the vehicle key is entrusted to the Hotel. The Hotel does not assume responsibility for the custody, management, or security of the vehicle. However, if damage is caused by the Hotel's intentional misconduct or negligence in the management of the parking facilities, the Hotel shall be liable for such damage.

Article 20 – Liability of the Guest

  1. 1. If the Hotel suffers any loss or damage as a result of the intentional act or negligence of a guest, the guest shall compensate the Hotel for such loss or damage.

Article 21 – Severability

  1. 1. If any provision of these Terms and Conditions or any other rules governing the use of the Hotel is determined to be invalid under applicable laws and regulations, such invalidity shall not affect the validity or enforceability of the remaining provisions.
  2. 2. If any provision of these Terms and Conditions or any other rules governing the use of the Hotel is determined to be invalid or is rescinded with respect to a particular guest, such determination or rescission shall not affect the validity or enforceability of that provision with respect to any other guest.

Article 22 – Governing Law and Language

  1. 1. The validity, interpretation, and performance of these Terms and Conditions and any other rules governing the use of the Hotel shall be governed by and construed in accordance with the laws of Japan.
  2. 2. These Terms and Conditions and any other rules governing the use of the Hotel may be prepared in multiple languages. However, in the event of any discrepancy or inconsistency between language versions, the Japanese version shall prevail and be deemed the authoritative text.

Article 23 – Amendments to These Terms and Conditions

  1. 1. The Hotel reserves the right to amend these Terms and Conditions whenever deemed necessary. In the event of such amendments, the Hotel shall publish notice of the changes, the revised Terms and Conditions, and the effective date of the amendments on its website at least one (1) month prior to the effective date of the changes.

Notes

  1. 1. The Basic Accommodation Charges shall be based on the rate schedule published by the Hotel.
  2. 2. Children are generally charged the same rate as adults. However, no charge will be made for infants who do not require bedding or meals. The Hotel may establish separate child or infant rates depending on the season or accommodation plan. In such cases, notice will be provided by an appropriate method.
  3. 3. For the purposes of these Terms and Conditions:
  • ・Infants are children aged 1 year to under 6 years old.
  • ・Children are aged 6 years to under 12 years old.
  1. 4. If applicable tax laws are amended, the revised laws and regulations shall apply.

Notes

  1. 1. The percentages shown above represent the cancellation charge as a percentage of the Basic Accommodation Charge.
  2. 2. If the length of stay is shortened, a cancellation charge equivalent to one day's accommodation charge (the first cancelled night) shall be applied regardless of the number of nights reduced.
  3. 3. Separate cancellation policies may apply to accommodation packages, promotional plans, special offers, or other arrangements specifically established by the Hotel. In such cases, the cancellation policy applicable to the relevant package, plan, or special arrangement shall prevail.
